By accessing or using Cristoforma ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Cristoforma ("we," "us," or "our"). Your continued use of the Service constitutes your acceptance of any updates or modifications to these Terms.

Cristoforma is an AI-powered spiritual companion application designed to assist users in their spiritual formation journey through conversation, Scripture exploration, and faith-based guidance. The Service uses artificial intelligence technology to provide responses and content. The Service is intended for informational and inspirational purposes only.

3. AI-Generated Content Disclaimer

You acknowledge and understand that:

  • The AI-generated content is NOT a substitute for professional pastoral care, licensed counseling, psychological therapy, medical advice, or professional religious guidance from ordained ministers or qualified professionals.
  • We make NO guarantees regarding the accuracy, completeness, reliability, or appropriateness of any AI-generated content. The AI may produce errors, inaccuracies, or content that is theologically disputed.
  • You are solely responsible for evaluating and acting upon any information or guidance provided by the Service. Any decisions or actions you take based on AI-generated content are at your own risk.
  • For serious spiritual, emotional, psychological, or mental health concerns, you should seek guidance from qualified professionals such as licensed therapists, medical professionals, or ordained religious leaders.
  • We expressly disclaim any liability for harm, loss, or damage arising from your reliance on AI-generated content, including but not limited to spiritual, emotional, psychological, financial, or physical harm.

5. User Conduct

You agree not to use the Service to:

  • Engage in any illegal, harmful, or fraudulent activities.
  • Generate, distribute, or promote content that is harmful, abusive, defamatory, obscene, or otherwise objectionable.
  • Attempt to manipulate, exploit, or misuse the AI system for unintended purposes.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying algorithms of the Service.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRISTOFORMA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY CONTENT PROVIDED BY THE SERVICE, OR ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS LESS.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Indemnification

You agree to indemnify, defend, and hold harmless Cristoforma, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; (d) any content you submit, post, or transmit through the Service; or (e) your reliance on any AI-generated content provided by the Service.

9. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof, are the exclusive property of Cristoforma or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Service without prior written consent.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

11. Modifications to Terms

We reserve the right to modify these Terms at any time, in our sole discretion. If we make material changes to these Terms, we will notify you by posting the revised Terms on the Service with an updated "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

13. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in the English language and take place in Delaware, USA, or remotely as agreed by the parties. The arbitrator's decision shall be final and binding. You agree that any arbitration shall be conducted on an individual basis and not as a class action or representative proceeding. YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, which shall remain in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
